Whether in global markets, in the EU, or in international law - constitutions are long being formed beyond the state with severe consequences. In this post-democratic constitutionalism, a market-liberal program is given the status of an unquestionable consensus, reinforced by a higher-ranking law. Kolja Möller connects system theory, post-Marxist resources, and democracy theory to show, using different examples: Neither returning to national democracy nor spreading individual global citizen rights will improve this situation. Instead, a deposing power is needed to resolve the substantive over-formation of constitutions beyond the state. The new and critical constitutional theory thus created challenges the current diagnoses of declining status of democracy.
